CLARITY FROM THE BEGINNING

Terms &
conditions.

Booking, payment and orchard-development terms drawn from our season 2026–27 agreement.

VERSION / 1 NOVEMBER 2026

01

Company and scope

Kashmir Agriventures Private Limited (CIN U46692JK2025PTC017388). Head Office: Dil Pzeer Lane, Baghat Barzulla, Srinagar. Branch Office: Zazna, Opp Fruit Mandi, Ganderbal. Contact: contact@kashmirag.com / +91 7006579277. These online terms explain the booking process and summarise our Orchard Development Agreement for season 2026–27. The completed and signed project agreement, identified quotation, layout and specifications record the agreed project. Later website changes do not alter an existing contract. Variations require written approval by both parties.

02

Enquiries, availability and confirmation

Submitting a form creates an enquiry, not a confirmed order, reserved stock, payment receipt or guaranteed planting date. The Company confirms crop / cultivar, rootstock, grade, quantities, availability, intended supply season, scope and price in writing. The enquiry reference generated by this website is for correspondence only. The Grower must have lawful possession and authority to develop the site, disclose access restrictions and known site problems, and arrange required co-owner or lessor consent. No interest in land is transferred.

03

Reference packages and agreed prices

Apple single leader: ₹2,00,000 per accepted kanal, with a planning allowance of 150 plants, 7+ feather. Apple Bibaum®: ₹2,05,000 per accepted kanal, with a planning allowance of 110 two-leader nursery plants. Cherry and other crops are priced by agreed cultivar, rootstock and grade; feather count is not a default cherry quality criterion. Reference packages include agreed plants, trellis and drip with installation labour. Final quantities depend on the approved field layout and include pollinizers. Reconcile area, plant count, specifications, taxes, exclusions and total price before signing. Later quantity changes require a written price adjustment; substitutions and extra charges require consent. No double billing or automatic freight / exchange-rate increase applies. Prices are fixed except for signed variations or lawful tax changes.

04

Booking and payment milestones

Standard booking is ₹10,000 unless another actual amount is agreed in writing. It is part of the total contract price, credited once against the first 40%; excess booking credit carries forward. The second 40% is due before trellis / drip mobilisation and the final 20% before release / delivery of compliant plants. Follow the dates and amounts in your confirmed commercial schedule. Plants-only orders and other services follow their written quotation. The Company issues receipts and confirms reserved plants and the intended supply season after verification. Pay only the named Company account on the verified Company invoice. This site does not collect card details or UPI PINs, process transfers, verify bank receipt or issue an automatic paid receipt.

05

Timely payment

Each instalment must be paid in full by the agreed milestone and date. If an undisputed payment remains overdue after seven days’ written notice, the Company may suspend procurement, installation, plant release or other work and revise the programme. Delay or seasonal disruption directly caused by the Grower’s late payment is the Grower’s responsibility. This does not excuse earlier Company breach, defective supply or defective workmanship.

06

Included work and site responsibilities

The agreed package provides site evaluation, written recommendations, layout, scheduled plants, trellis / drip installation and commissioning, and the guidance described below. Drip work runs from the agreed secondary-filter connection to scheduled plants. Ordinary installation-material and labour transport is included unless expressly excluded in the signed schedule; plant delivery and planting duties must be allocated there. Unless included in writing, the Grower provides land preparation, fencing, drainage, water source, tank, pump, primary filtration, electricity, civil works, trenches, soil amendments, abnormal rock work and routine labour / inputs. Anti-hail equipment and hands-on pruning are separately priced. Safe access, working irrigation, basic records and compliance with reasonable written care advice are required. Late planting needs an agreed technical plan.

07

Delivery, inspection and identity

Plants must match the agreed cultivar / clone, rootstock and grade, with traceability and lawful import / quarantine clearance where applicable. PEQ restrictions must be observed. Delivery counts, condition, identity, grade, batch, planting date and discrepancies are recorded separately. Report visible shortages or damage promptly; acceptance does not waive hidden-defect or identity claims. Unless varied in the signed schedule, Company transit risk ends when conforming plants are tendered at the agreed delivery point; each party bears handling / storage damage under its control. Substitutions require Grower consent. Delays must be notified promptly. If the latest agreed seasonal delivery date cannot be met, the Grower may accept written rescheduling or terminate affected scope under the cancellation provisions.

08

Limited non-sprouting replacement cover

Eligible non-sprouting reported within 90 days after planting is covered only above an 8% threshold, assessed separately for each agreed crop / cultivar-rootstock batch and rounded down to a whole plant. For 150 plants the threshold is 12; if 25 are eligible non-sprouting, 13 are replaced. Eligibility requires establishment stress in otherwise conforming stock and reasonable compliance with written care advice. Ordinary mortality after sprouting and Grower-caused handling, irrigation, drainage or treatment losses are excluded. The threshold and exclusions do not excuse short delivery, wrong identity / grade, defective stock, latent defects present at supply or Company negligence. Replant sites may require soil testing, old-root removal, drainage correction, treatment and improved management; agreed site measures must be followed.

09

Replacement assessment and remedy

Report claims within 90 days and permit inspection. The Company acknowledges within seven days and inspects within 15 days where practicable. Record findings and reasons; timely notice remains valid if inspection is later. Disputed cases may be referred to a mutually agreed independent horticultural expert / laboratory, with costs initially shared. Refusal to sign an assessment alone does not invalidate a claim. Eligible establishment replacements are provided once in the next suitable season by an agreed written deadline, matching cultivar, rootstock and grade unless a substitute is accepted. Company delivery to the original point is included; ordinary replanting labour is Grower-paid unless due to Company breach. If stock is unavailable by the deadline, agree a substitute or refund the affected plant value within 30 days. Replacement stock retains conformity rights but has no new discretionary establishment cover unless agreed.

10

Handover and workmanship

Completed trellis and drip are inspected and tested against agreed specifications; outstanding work and correction dates are recorded. Official establishment handover occurs after plants have sprouted and the site and systems perform satisfactorily, normally around three to four months after planting. Unresolved failures require an agreed written remedy list and deadlines. Handover does not end continuing guidance, unused free visits, replacement claims or other obligations. Defective supplied installation materials / workmanship notified within 12 months of commissioning are remedied at Company cost. Wear, misuse, unauthorised alterations and loads beyond the agreed design are excluded only to the extent relevant. Anti-hail, snow and special-load capacity must be expressly specified.

11

Twelve months of orchard guidance

The package includes 12 months of guidance from the recorded planting date: reasonable remote advice during business hours and two site visits free of visit fees and travel charges. Additional advisory visits require Grower approval of the charge in writing beforehand. Routine labour, pruning, sprays, fertilisers and other inputs are separately payable unless included. Visits to correct Company defects are not paid advisory visits and do not use the two free visits. Daily orchard management remains the Grower’s responsibility. No monthly free-visit commitment applies.

12

Varietal conformity and expectations

Confirmed cultivar / clone, rootstock or grade mismatch may be claimed even if only some plants are affected. Nursery labels do not disclaim responsibility. Assessment uses traceability and suitable expertise / testing; failure to fruit alone does not establish mismatch. The identity undertaking continues through first representative fruiting and for at least three years after planting, without shortening statutory rights. Confirmed mismatches qualify for conforming replacement in the next suitable season, including reasonable attributable delivery, removal and replanting costs, or an affected plant-value refund where replacement is unavailable or not agreed. Other lawful remedies remain, without double recovery. Yield, bearing date, fruit price, profitability, subsidy, empanelment and finance are not guaranteed.

13

Cancellation, delay and refunds

For material breach, give written particulars and 30 days to remedy, or a reasonable shorter period agreed for seasonal urgency. Unsafe work may be suspended immediately with reasons. Grower convenience cancellation requires 30 days’ notice; Company convenience cancellation requires Grower consent. Events beyond reasonable control require prompt notice, mitigation and revised dates; routine procurement / price changes and a party’s own non-compliance are not automatically excused. On termination the Company provides an itemised settlement within 15 days. Charge only agreed completed work, conforming goods and reasonable evidenced unavoidable cancellation costs, less supplier refunds, resale and other recoveries. Reserved stock charged to the Grower must be identified and made available subject to lawful clearance and payment. No automatic booking forfeiture or double recovery applies. Undisputed excess advances are refunded within 30 days of termination without waiting for disputed items.

14

Responsibility, notices and disputes

Each party is responsible for losses caused by its breach, negligence or misconduct and must reasonably mitigate loss. Fraud and non-excludable statutory rights are not excluded. Send notices to recorded contacts, retain delivery / acknowledgement evidence, and use a second channel if unacknowledged. Seek amicable settlement within 30 days; unresolved disputes go to competent Jammu & Kashmir courts without excluding competent consumer or statutory forums. Applicable Indian law governs. Scheme-funded work requires identified signed sanction-related conditions. Publicity or publication of identifiable site images requires separate optional consent. The Company remains responsible for subcontracted work.

Online details and acceptance

Your orchard form is stored in this browser tab for the next step. Payment details and the transaction reference are prepared locally and are shared with WhatsApp only when you choose to open and send the message. Attach screenshots directly in WhatsApp; this website does not upload them. This static flow has no central booking or payment register. WhatsApp and your bank / UPI app apply their own terms and privacy practices. The online checkbox records an acknowledgement in the prepared message; it does not replace the completed commercial schedule, applicable stamping and signatures or legally suitable authenticated electronic signing of the project agreement. Amendments require both parties’ written acceptance.
